‘Vicious Dog Owner’ Denied Bail
The High Court in Lilongwe on Monday July 26, denied bail to Dean Van Scalhwal whose dogs viciously attacked a 72 year old Ceiphus Chimdima last week.
There was cacophony at the court as people were buying for Scalhwal’s blood who has since been charged with an act of keeping dangerous animals and negligence contrary to Section 46 subsection B and Section 181 of the penal code respectively.
In their submission the defence team argued that the court should give bail Scalhwal in order to give him a chance to be attending Chimdima in hospital.
But the state counter argued that Scalhwal could be taking care of the victim even under police custody and also that it needed 14 days to conclude investigations.
And in its ruling, the court said it will determine on whether or not it should grant bail to Scalhwal on Wednesday after examining both arguments.
Meanwhile the Human Rights Consultative Commission (HRCC) National Aids Commission (NAC) and Malawi Congress of Trade Union on Monday morning led hundreds of Malawians in a peaceful demonstration, protesting against Dean Van Scalhwal’s behavior in Lilongwe .
People carrying placards with various messages to the Scalhwals and authority, delivered a petition the Minister of Home Affairs and Internal Security Aaron Sangala who refused to say anything saying the matter was still in court.
In a joint press briefing, the three organizations demanded the immediate deportation of the white couple and a disciplinary action against the Kamuzu Central Hospital personnel who conducted and HIV on Chimdima on pressure from the couple.
HRCC’s chairperson Undule Mwakasungula said deporting the couple would send a clear message to would be racists.
“Yes, we are a Warm Heart of Africa, but our warmth should only be extending to the warm hearted as well. And people of Dean Van Scalhwal don’t deserve our warm-heartedness and should be deported out side the country with immediate effect. On the other hand government should also take disciplinary measures against the medical personnel who carried the HIV test on the victim.
