The Trio: To pay costs

The Ministry of Homeland Security has regrettably noted that during the demonstrations held on 20″ June, 2019 and 4″ and 5″ July, 2019, the Conveners and Organizers, having undertaken to hold peaceful demonstrations, failed to abide by this undertaking with the effect that some of the demonstrators inflicted personal injuries on some persons and loss, damage and destruction to property.

The Ministry would like to draw the attention of all those that suffered personal injury or loss and damage to their property during the demonstrations to the provisions of section 106 of the Police Act. By section 106(1) of the Police Act, if any riot damage occurs as a result of an assembly or a demonstration, every organization on behalf of or under the auspices of which the assembly or demonstration was held, the convener, and every person participating in the assembly or demonstration, as the case may be, shall be liable for that damage as a joint wrong-doer together with any other person who unlawfully caused or contributed to such damage. Further, under section 106(2) of the Police Act, any person or organization held liable for riot damage under subsection (1) shall, notwithstanding that subsection, be deemed to be liable in any civil claim in respect of

Recourse against, or contribution by, that person or organization for intentionally and unlawfully causing or contributing to the cause of the riot damage; or (b) contribution by the other person who, or other organization which, is jointly liable for the riot damage.

The Ministry would therefore request all those that suffered personal injury during the demonstrations to obtain medical reports detailing the injuries and the extent of permanent incapacity, if any and bring these reports to the attention of the Officer in Charge of their nearest police station together with their personal addresses and telephone numbers. Similarly, all those that suffered loss or damage to property are requested to prepare details of the loss and damage and, where necessary, expert reports on the cost of repairs to their properties and bring them to the attention of the Officer in Charge of the nearest Police Station. Government Ministries and Departments or Agencies that have suffered loss and damage to property are similarly requested to obtain expert reports on the value of any loss and damage as well as repair estimates thereof and bring these to the attention of the Secretary for Homeland Security.

Government, in keeping with its mandate to observe the rule of law, intends to collate all these reports and arrange for the commencement of a class action lawsuit against all the Conveners and Organizers of the demonstrations so as to, in keeping with the statutory provisions cited above, hold them liable for the personal injury, loss and damage and obtain compensation from them with respect to the injuries, loss and damage.

    I think mutharika government is trying to play the most stupid game. Who are they trying to fool around. DPP is a party full of murderers thugs and corrupt politicians if not enough albino poachers. Mutharika must leave our country and go where he belongs we don’t need him.where was he when people fought for freedom in 1993- 1994 , he is a stupid man ever existed on this planet earth. After all when people demonstrate it means there is an anger around them hence damages.

    hey; the one to pay for demo victims is the attorney general and not these three…you mean you do not know this…the one who paid Leston Mulli k9 billion was attorney general and not demo organisers; case closed,.people can still get back to the streets and make more damage, the one who is going to pay the victims is the attorney general..

    nanga chilima ndi chakwera 1993/94 ankatani? if you don’t know apm was one of the law consultant called to help draft the democratic constitution we are using, in short he was part of the democratization process. he is also one of the freedom fighters in the class of chipembere and he left this country running away from the mcp dictatorship which is now trying all it can to bounce back with the help of myopics in the class of chilima. this time around the law is clear the organizers of the DemonStrations will pay. mulli had different cases: had his businesses suffocated by jb administration because he was from the south and a lhomwe. hanah with the directive from kasambala blocked this guy’s businesses not to transact with any government department, jb through kasambala ordered the tressury not to pay him already transacted businesses etc and all this was because he was a lhomwe and from the south. this is the same story now with mtambo attacking ansah fiercely after finding a loophole in chilima’s selfishness and arrogancy. these stupid fools must pay. where on earth could they act against the will of the simple majority? be ashamed of yourselves you murderers, robbers, intimidators. the perpetrators of albino killings for campaign gimmic to implicate the innocent GOD will judge you. ZILIPIRE basi zimenezi!!!!

    dpp is smarter than utm which is now full of cashgators and murderers who are hiding behind notorious chilima: the cashgate climinal convict who tried in vain to eliminate mphwiyo to amass zilembwe. under dpp we witnessed the use of our own taxes in construction works and the running of our elections, this is great. chilima ndi chakwera flopped in the elections why are they damaging our businesses and killing us in the ambulances? how do they know that i didn’t vote for chilima nor chakwera? what is happening on kasiya santhe road on makeshift barricades by hi5 masked youth league in demanding k1000s from motorists using that road is it acceptable? how do they know that those people didn’t vote for their power hungry hi5 god maker? kaya katswiri wamalamulo wapazodiak awabakila koma alipire basi ife taduka atibwezere zathu komanso moyo wa patient anafera muambulance abweze.
