CCP, The Constitutional Order, After Bingus Demise
Chipani Cha Pfuko
The Change of Guard
who we hear passed away between Thursday, 5th April, 2012 and today, 6th April 2012; The exact time of death has not officially been announced yet – at the time of writing.
However, listening on the local radio stations and on ENews TV; we hear there was a meeting held by DPP Ministers and, probably others to discuss the way forward after the tragedy that has befallen us. It has also been announced that Right Honourable (Her Excellency) Joyce Banda was not invited to that meeting. We would like to believe that the meeting was solely a DPP meeting and that; it had nothing to do with who takes over the reins of power after the demise of the Ngwazi.
Who takes over as President is quite clear in the Republican Constitution and it should not become an issue for any political party to decide upon. Section 83(4) of the Constitution of The Republic of Malawi says, “Whenever there is a vacancy in the office of President, the First Vice-President shall assume that office for the remainder of the term and shall appoint another person to serve as First Vice-President for the remainder of the term”
The Constitution does not talk about which party the Vice-President should come from and as far as we know, this constitution has not been amended recently and, any amendment done now with the Right Honourable Joyce Banda’s face in mind will certainly be illegal.
Politics hurts vacuums and, on behalf of Chipani Cha Pfuko and my own behalf, I urge those officially vested with the powers to call Presidents into office at a time like this, to do so now before the country descends further into chaos. Malawi is bleeding and we have no time to waste because a few greedy individuals think it is alright to go against the Constitutional Order. Remember, “Lamulo Liposa Mphamvu”
All of us interested in the Presidency should wait our turn when polling centres for the Presidential vote are open again in 2014; it is usually done in May!
