Kasambara’s Lawyer Wapona Kita Shrugs off ACB
Lawyer Wapona Kita who is representing a president Bingu wa Mutharika critic Ralph Kasambara on Monday appeared before the Anti-Corruption Bureau officials where he was interrogated on how his client was bailed out hence the judiciary and court staff being on strike.
Kita was summoned to appear before ACB last week and there were speculations that the body wanted to arrest him following rumors of
the body processing a warrant arrest for the lawyer.
Kita broke the good news about his release and freedom immediately after finishing the interrogations with the ACB officials.
“Thanks for your prayers and best wishes; am back from the ACB and they have not arrested me as it was speculated” wrote Kita.
He further clarified on what had transpired at the meeting where he claims to have refused to give out any information to ACB officials
with a backing by Section 51 of the Corrupt Practices Act.
“They wanted to take a witness statement regarding the role I played in the court granting bail to Kasambara. I declined to answer the
questions, relying on Section .51 of the Corrupt Practices Act which does not allow a lawyer to disclose to the ACB information regarding how he handled a matter on behalf of a client.” said Kita.
“They kept asking questions but I kept telling them that I invoke Section .51. They respected my decision and I was allowed to go” added Kita.
Kita played a vibrant role in making sure that his colleague Ralph Kasambara who is also Human Rights Activist and a critic to president Mutharika government be released from Chichiri prison where he was locked up following his earlier arrest.
He was later rearrested and transferred to Zomba maximum prison where he was locked in a room meant for those who are on death row or they are serving a life imprisonment sentence.
Meanwhile, Kita, Civil Society Organizations, Politicians, religious leaders and various international organizations have called upon
president of Malawi through Malawi Police to release Kasambara whom they say is being detained without reason.
Kasambara is currently at Mwaiwathu hospital under heavy police security where he is receiving treatment following a heart problem
after his arrest.
According to the wife of Kasambara and his lawyer Kita, the patient was supposed to travel abroad to undergo medical attention but his
arrest has disturbed the whole process putting his life in danger.
